Unpublished, time-sensitive and proposed rules for October 21, 2016:

PROPOSED RULE: DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to provide a more transparent means of documenting the impact of costs incurred during the undefinitized period of an undefinitized contract action on allowable profit. Comments on the proposed rule should be submitted in writing on or before December 20, 2016, to be considered in the formation of a final rule. PROPOSED RULE: DoD is proposing to amend the Defense Federal Acquisition Regulation Supplement (DFARS) to expand the prescription for use of the Federal Acquisition Regulation (FAR) Government property clause. Comments on the proposed rule should be submitted in writing on or before December 20, 2016, to be considered in the formation of a final rule. TEMPORARY RULE: NMFS is exchanging unused flathead sole and rock sole Community Development Quota (CDQ) for yellowfin sole CDQ acceptable biological catch (ABC) reserves in the Bering Sea and Aleutian Islands management area. This action is necessary to allow the 2016 total allowable catch of yellowfin sole in the Bering Sea and Aleutian Islands management area to be harvested. Effective October 21, 2016 through December 31, 2016.

TEMPORARY RULE: NMFS is opening directed fishing for Pacific Ocean perch in the Bering Sea subarea of the Bering Sea and Aleutian Islands management area. This action is necessary to fully use the 2016 total allowable catch of Pacific Ocean perch specified for the Bering Sea subarea of the Bering Sea and Aleutian Islands management area. Effective 1200 hrs, Alaska local time (A.l.t.), October 20, 2016, through 1200 hrs, A.l.t., December 31, 2016.

PROPOSED RULE: We, NMFS, announce proposed revisions to the Code of Federal Regulations (CFR) to update the descriptions of Pacific salmon and steelhead (Oncorhynchus spp.) species currently listed as threatened or endangered under the Endangered Species Act of 1973 (ESA). Revisions include the addition or removal of specific hatchery programs, as well as clarifying changes to the names of specific hatchery programs included as part of the listings of certain Pacific salmon and steelhead species. These proposed changes are informed by our recently completed 5-year reviews under ESA. We do not propose to change the ESA-listing status of any species under NMFS’ jurisdiction, or modify any critical habitat designation.
